Mr H works in a factory that makes glass bottles. On this particular day, he had to change something within the machine. This was a fairly common practice, and something that is done often.
Unfortunately on this occasion, whilst Mr H was changing the item, a colleague on the other side of the machine accidentally hit a button and started the machine up. Mr H’s hand was trapped and he suffered injuries.
Many firms would tell Mr H he didn’t have a claim because it wasn’t his employers fault. Luckily for Mr H we know better. His employers are at fault both because it simply should not be possible for the machine to start when he was working within it, and because an employer is most often responsible for the actions of it’s employees.
Mr H will now be compensated and changes made to the machine to stop this happening again.
